Savora/Terms

Terms of Service

01

Parties and Scope

These Terms of Service govern the sale of goods through savora.no by Savora AS, a company registered in Norway and operating from Oslo (the "Seller"). By placing an order, you (the "Customer") confirm that you are at least eighteen years of age, or have obtained the consent of a parent or legal guardian, and that the information provided by you is accurate and complete. These Terms apply to all orders to the exclusion of any other terms proposed by the Customer. Communication with the Seller shall be addressed to info@savora.no.

02

Formation of the Contract

The display of products on savora.no constitutes an invitation to treat and not a binding offer. An order placed by the Customer constitutes an offer to purchase the selected products on these Terms. A binding contract of sale is formed at the moment the Seller dispatches an order confirmation to the email address provided by the Customer. The Seller reserves the right to refuse or cancel any order, including in cases of suspected fraud, manifest pricing error, or unavailability of stock; in such cases any sum paid will be refunded in full.

03

Prices, Currency and Taxation

All prices on savora.no are quoted in Norwegian Kroner (NOK). For deliveries within Norway, prices are inclusive of value added tax (merverdiavgift) at the applicable statutory rate. For deliveries outside Norway, Norwegian VAT is removed at checkout; the Customer is solely responsible for any import duties, taxes, customs charges, and handling fees levied in the country of destination, which are not included in the order total or shipping fee. In the event of a manifest pricing error, the Seller is entitled to cancel the affected order and refund any amount paid in full, in lieu of fulfilment.

04

Payment

Payment is taken in full at the time the order is placed and is processed by the Seller's payment service provider through accepted means including major credit and debit cards, Vipps, and other methods displayed at checkout. Title to the goods passes to the Customer upon dispatch, subject to receipt of payment in cleared funds. The Seller does not collect or store full card numbers.

05

Delivery

Orders are dispatched from Oslo, Norway. Indicative delivery times, exclusive of any customs delay, are two to five working days within Norway, five to ten working days within the European Economic Area and the United Kingdom, and seven to fourteen working days for the rest of the world. Delivery times are estimates and do not form part of the contract. Risk of loss or damage to the goods passes to the Customer upon delivery to the address provided. Where the Customer is a consumer, this provision does not affect the Customer's mandatory rights under applicable consumer law.

06

Product Descriptions and Conformity

The goods sold on savora.no are produced in part by hand from natural materials. Reasonable care is taken to ensure that descriptions, photographs, and specifications are accurate, but minor variations in colour, grain, finish and dimensions are inherent in the nature of the materials and do not constitute a defect. The goods shall conform to the contract within the meaning of section 15 of the Norwegian Consumer Purchases Act (forbrukerkjøpsloven).

07

Right of Withdrawal

A Customer who is a consumer is entitled to withdraw from the contract within fourteen days of receipt of the goods, in accordance with the Norwegian Right of Cancellation Act (angrerettloven) and Directive 2011/83/EU on consumer rights. The exercise of the right of withdrawal, the condition in which goods must be returned, the allocation of return shipping costs, and the timing of refunds are governed by the Seller's Refund Policy, which forms an integral part of these Terms.

08

Statutory Warranty

Customers who are consumers benefit from the statutory warranty for non-conformity provided by the Norwegian Consumer Purchases Act, including the right to require remedy of the defect, replacement, a price reduction, or rescission of the contract, on the conditions and within the time limits set out in that Act. Claims under the statutory warranty must be notified to the Seller within a reasonable time after the Customer discovered or ought to have discovered the defect. The Seller shall bear the cost of return shipping in cases of confirmed non-conformity.

09

Limitation of Liability

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for any matter for which it would be unlawful to exclude or limit liability. Subject to the foregoing, the Seller's aggregate liability arising out of or in connection with any single order, whether in contract, tort, or otherwise, shall not exceed the price paid by the Customer for the goods comprised in that order, and the Seller shall not be liable for indirect, incidental or consequential loss.

10

Force Majeure

The Seller shall not be liable for any failure or delay in the performance of its obligations to the extent that such failure or delay is caused by an event beyond its reasonable control, including acts of God, war, civil disturbance, fire, flood, epidemic, embargo, labour dispute, or failure of public utilities or carriers.

11

Intellectual Property

All intellectual property rights in the Savora name and logo, in the photographs, descriptions and other content published on savora.no, and in the design of the goods, are the exclusive property of Savora AS or are used under licence. No right or licence is granted to the Customer in respect of such rights other than the limited right to view the website for the purpose of placing an order. Any other use, including reproduction, commercial exploitation, or use as input to machine learning systems, is prohibited save with the prior written consent of Savora AS.

12

Personal Data

The processing of personal data in connection with the performance of these Terms is governed by the Seller's Privacy Policy, which forms an integral part of these Terms.

13

Governing Law and Jurisdiction

These Terms and any contract formed under them are governed by, and shall be construed in accordance with, the laws of the Kingdom of Norway, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of Oslo District Court (Oslo tingrett) as the agreed venue, save where mandatory consumer protection rules in the Customer's country of habitual residence confer the right to bring proceedings before another court. Consumers resident in Norway may refer disputes to the Norwegian Consumer Authority (Forbrukertilsynet); consumers resident elsewhere in the European Union may use the European Commission's Online Dispute Resolution platform.

14

Severability and Amendment

If any provision of these Terms is held by a competent court to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. The Seller may amend these Terms from time to time; the version applicable to a given order is the version published on savora.no at the moment the order is placed.
